Terms and Conditions of Elysian Charm Studios (ECS)

Acceptance of Terms:

   1. Account Registration

• In order to access certain features of our website, you may be required to register an account. You must provide accurate and complete information during the registration process. You are solely responsible for maintaining the confidentiality of your account and password.
• We will not be liable for any losses or damages arising from unauthorised access to your account.

Your details are protected by GDPR.  If you subscribe to our site, you may be contacted via email with news, offers or promotions.  Your details are not shared with third parties. 

    2. Product Listings and Descriptions

• We strive to provide accurate and up-to-date product listings and descriptions on our website. If you need further information on goods or products, please go to our #CustomerContactCentre section where you can comment of ask questions.  We will aim to get back to you as soon as possible. 
• Prices displayed on our website are subject to change without notice. We reserve the right to modify or discontinue any product without prior notice.

    3. Ordering and Payment

• By placing an order through our website, you are making an offer to purchase the products at the prices listed. We reserve the right to accept or reject any order at our discretion.
• We accept various payment methods as indicated on our website. You agree to provide accurate and valid payment information.
• All payments made through our website are processed securely. However, we will not be responsible for any unauthorised access to or disclosure of your payment information.
• We are not responsible for payments taken from your account that may prompt bank charges or fees.  You are solely responsible to ensure that you have funds to cover purchases or services from our site.

    4. Shipping and Delivery

• We will make reasonable efforts to ensure timely delivery of your orders. However, we are not responsible for delays or failures in delivery beyond our control.
• Shipping costs and estimated delivery times are provided on our website. These may vary depending on your location and the shipping method chosen.
• If your goods do not arrive 3 working days after your estimated delivery date you will need to contact us via the #CustomerContactCentre area of our site so we can start an investigation into non-delivery.  This must be done within 20 days of the original purchase date. We will then contact you for further details.

  5. Returns and Refunds

Here at Elysian Charm Studios, we hope you are #Charmed with your products, but if you need to return your goods, you can. Please read the following carefully before making a purchase:

• You must provide valid and clear proof of purchase such as an online receipt, invoice or bank statement.
• Products must be returned in re-saleable condition in the original packaging within 28 days of the original purchase.
• As a small business, Elysian Charm Studios can only reimburse return postage if the item is faulty, however, if the return is due to other reasons the customer will need to cover postage.
• You may return faulty goods that are damaged on arrival or have manufacturing faults within 28 days, and we will be happy to offer you a replacement (if goods are available) or an exchange. Where possible we will also try and repair your purchase, however, if this is not possible, we will offer you a ECS gift voucher. 
• We reserve the right to refuse returns or refunds if the product or goods are damaged due to misuse (such as washing and drying against care instructions), tampering (such as picking, peeling, sticking or attempting to change or alter in any way), improper handling (not handling delicate items with care, allowing children to use goods that are heavy or fragile without supervision).
• We reserve the right to investigate why your goods are being returned, however, your consumer rights are not affected.

     6. Intellectual Property

• All content on our website, including but not limited to text, images, logos, and trademarks, is the property of Elysian Charm Studios (ECS) and is protected by applicable intellectual property laws.
• You may not use, reproduce, distribute, or modify any content from our website.
• You may not reproduce, distribute, or modify any physical products purchased from Elysian Charm Studios.

     7. Limitation of Liability

• To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
• We shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the use of our website or services.

     8. Indemnification

• You agree to indemnify, defend, and hold harmless Elysian Charm Studios (ECS) its affiliates, employees, and agents from any claims, damages, liabilities, costs, or expenses arising out of your use of our website or services, or your violation of this Agreement.

     9. Modifications to the Agreement

• We reserve the right to modify, amend, or update this Agreement at any time without prior notice. It is your responsibility to review this Agreement periodically for any changes.

     10. Governing Law and Jurisdiction

• This Agreement shall be governed by and construed in accordance with the laws of the United Kingdom. Any disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts in the United Kingdom.

     11. Severability

• If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

     12.VAT

• We are a small business, and our current annual turnover is under the HMRC VAT turnover threshold.  As such, we do not include VAT in our retail prices.
